Can the appeal against fine result in an arrest?

A citizen was punished for an offence with a fine and when he appealed against it – the court changed the penalty to 10 days of arrest. In the opinion of the Commissioner the case needs to be carefully considered, since such increase in penalty may be in conflict with the Constitution. For this reason, the Commissioner turned to the Minister of Justice with a general application concerning possible inconstitutionality of the provision of the Code of Criminal Procedure.
