The Government Legislation Centre responds as to why the judgement of the Constitutional Tribunal of 9 March was not published

The President of the Government Legislation Centre (RCL) has not issued a decision refusing the publication [of the Constitutional Tribunal's judgement of 9 March concerning the amendment of the Constitutional Tribunal Act of 22 December 2015], therefore she cannot answer the question asked by the Commissioner for Human Rights pertaining to the legal basis for the refusal to publish the judgement.

On March 17, the Commissioner asked the President of the Government Legislation Centre about the reasons for the failure to publish the Constitutional Tribunal's judgement of 9 March 2016 in case K 47/15 in the Journal of Laws, as well as about the legal basis of the refusal to publish this judgement.

Now he has received a response.

The President of the GLC, Jolanta Rusiniak, indicates that the principles and mode of publication of the Constitutional Tribunal's judgements are indicated in the Constitution and in the Act on Publishing Normative Acts (Journal of Laws of 2016, item 296). In accordance with this act, the President of the Council of Ministers is the responsible authority, as they publish the Journal of Laws of the Republic of Poland (in which the judgements of the Constitutional Tribunal are published). The President of the Council of Ministers does so with the help of the Government Legislation Centre.
