The Act on the Commissioner for Human Rights

Article 1.4. The Commissioner shall perform the function of the inspector for the prevention of torture and other cruel, inhuman or degrading treatment or punishment (National Prevention Mechanism) within the meaning of the Optional Protocol to the Convention against torture and other cruel, inhuman or degrading treatment or punishment adopted by the United Nations General Assembly in New York on 18 December 2002 (Dz. U. of 2007, No 30, item 192).

Article 8.2.  Commissioner shall regularly examine the treatment of prisoners.

Article 13.1a When pursuing the task referred to in Article 8( 2), the Commissioner also has the right to:
1) record sound and image in places where prisoners are detained, upon the consent of the persons to be recorded,
2) meet people deprived of their liberty with no other people present and meet people who, according to the Commissioner, may provide important information.

1b. The recorded image and sound:
1) shall be kept in the Office of the Commissioner for Human Rights in rooms secured against unauthorised access for the period required by a given case, however not longer than for 10 years,
2) shall be made available to the person recorded and to their statutory representative or plenipotentiary.

Article 17c. The Commissioner may process any information, including personal data referred to in Article 27( 1) of the Act of 29 August 1997 on the protection of personal data (Dz. U. of 2002, No 101, item 926, as amended 2)) necessary to perform the Commissioner's statutory tasks.
